1: Acceptance of terms & conditions of use
1.1 Please read through the below terms & conditions in regards to the use of this website. By using the website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions please immediately stop using the Website.
2: Change of Use
The PC Shop reserves the right to:
2.1 Change or remove The PC Shop website or any part of it without notice. The PC Shop shall not be liable to you for any such change or removal and change to the Terms and Conditions at any time. Your continued use of the Website after any changes will be deemed to be your acceptance of such change.
3: Copyright & Intellectual Property Rights
3.1 All copyright, trademarks and all other intellectual property rights in The PC Shop website and its content are owned by or licensed to The PC Shop or otherwise used by The PC Shop as permitted by law.
3.2 In accessing the website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the website for personal, non-commercial home use only.
4: Scraping & Framing
4.1 Use of systems or software to extract data from thepcshop.co.za website is prohibited unless the third party has directly concluded a written licence agreement with The PC Shop in which permits it access to The PC Shop price, stock and listing information. No website or persons may frame this website or any pages within this website in any way
5: Limitation of Liability
5.1 The PC Shop website is provided on an AS IS and AS AVAILABLE basis. The PC Shop has taken all reasonable steps to make sure that the website content is accurate and complete.
5.2 Insofar as legally permissible, The PC Shop will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of data, profits, business, opportunity) arising from or in connection with the use of the Website.
5.3 The PC Shop makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
5.4 Under no circumstances (including negligence) will The PC Shop, directors, officers, employees, agents, suppliers or any other party involved in creating, producing, transmitting or distributing our website or related services be liable for any indirect, incidental, special or consequential damages arising from or in connection with the use or inability to use the website or any content provided by or through the website, or resulting from any unauthorised access to or alteration of your transmissions or data, or other information sent or received, including but not limited to, damages for loss of profits, data or other intangibles, even if we have been advised of the possibility of such damages.
5.5 Liability to a customer in regards to an order placed on the website will never exceed the total price of the order charged to the client.
6: Indemnity
6.1 You agree to indemnify and hold The PC Shop, it’s directors, officers, employees and agents harmless from and against all liabilities, legal fees, losses, damages, costs and other expenses in relation to any claims or actions brought against The PC Shop arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this website.
7: Severance
7.1 Should any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
8: Governing Law
8.1 These Terms and Conditions are governed by and construed in accordance with the law of South Africa and you hereby submit to the exclusive jurisdiction of the South African courts.

10: Incorrect pricing
10.1 While every effort is made to ensure correct pricing of products, there may be instances where the pricing is incorrectly published
10.2 When such incorrect pricing is obvious & unmistakable and where should have been reasonably recognised by the customer, The PC Shop may cancel the order placed and refund the customer monies paid.
11: Returns, refunds & cancellation of sales agreement
11.1 If a customer is not satisfied with a product, they have the right to do so within 7 business days of receiving the goods.
11.2 All goods returned must be in an unopened condition and remain unused in their original packaging.
11.3 To exercise the right to cancel orders, an email must be sent to sales@thepcshop.co.za providing the details of the goods as well as the relevant delivery and order numbers. Notification by phone will not be sufficient.
11.4 The returning of goods for a refund that have already been delivered will be at the cost of the customer and can only be done once The PC Shop has been notified by email and confirmed the return can be received.
11.5 Should an item be damaged in transit to The PC Shop, The PC Shop will not be liable for such damages and risk remains vested with the customer until The PC Shop accepts delivery. It is recommended the customer takes insurance when shipping returned goods.
11.6 A refund may be refused if goods and damaged or lost while in transit.
11.7 Once returned goods are received and tested, a refund will be processed within 30 days of receipt of goods.
11.8 If the goods are not returned within 7 days of notifying The PC Shop of your intention to cancel the order and request a refund, The PC Shop shall not be liable to refund you for such goods.
11.9 In line with the CPA a handling fee of up to 15% of the value of the product may be charged when the product/packaging is not returned in its original purchase condition.
12: Privacy
12.1 The PC Shop respects your privacy and will keep all your information strictly confidential and make sure that all your information is kept secure and is protected against unlawful processing, accidental loss, destruction or damage, alteration, disclosure or access. We will provide you with access to your personal information to view and update details. In the event of any unauthorised use, disclosure or processing of your personal information we will promptly notify you. Upon your request we will promptly return or destroy any and all personal information stored, save for that which we are legally required to retain.
12.2 The PC Shop will not retain your information for longer than the period for which it is needed unless we are legally required or upon the customers consent.
12.3 Customer information is collected when registering on the website, placing orders or submitting a query. Information collected this way includes, name, email address, ID number, delivery address, age, gender, contact number, occupation or account details.
12.4 The collected information may be used for the following, process orders and or transactions, competitions and promotions, send communications and improve customer service.
12.5 We will disclose or sell your private information to any third party without express permission to do so. We may disclose information where we are required to do so by law or law enforcement.
12.6 All personal information is stored with data encryption to protect your sensitive information
12.7 We use cookies to help us remember and process the items in your shopping cart, understand and save your preferences for future visits and compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.
Delivery Information
Most items listed on this website are not held in stock and are ordered through different suppliers when orders are placed. Pricing and stock levels are constantly updated based on information from these suppliers. Once orders are placed we will contact you with estimated delivery times. Larger items like desktop PCs may have a slightly longer lead-time (due to them having to be built and tested before shipping). Should an item not be in stock with our suppliers, we will contact you to offer a suitable replacement. You have the right to accept the replacement product or request a refund.
We offer the door to door couriers as our preferred delivery option. Alternatively you may collect from The PC Shop offices in East London once the goods have arrived from the suppliers, this usually take 1-3 business days after the order has been placed with the supplier. We will inform you via email or sms once the order is ready for collection. Courier deliveries generally take 2 business days to city centres with outlying areas taking 3-5 business days.
Warranties
All products sold on the website come with manufacturer warranties, these will vary according to the product and the manufacturer. All products that are faulty under the manufacturer warranty are to be shipped back to The PC Shop after email notification has been sent to sales@thepcshop.co.za. Once the item is received it will be inspected and tested. If the fault falls under the manufacturer’s warranty terms the item will be sent to the supplier to be repaired or replaced. This process at the supplier can take up to 2 working weeks. The PC Shop warranty agent will keep you up to date with progress reports from the supplier along this process. All shipping costs for items returned to The PC Shop will be for the customer’s account.
